Canopy Limited Warranty Terms & Refund Policy
Canopy warrants the Canopy respirator to the original owner to be free from defects in materials and workmanship for a period of 12 months (1 year) from the date of purchase, unless otherwise specified for a specific product or product component, including but not limited to the list of exceptions noted below. Canopy’s obligation under this limited warranty will be, at Canopy’s option, to repair or replace without charge the Canopy respirator or any of its components found by Canopy to have been defective during the limited warranty period, under the following terms:
- The warranty claim is made (i) by the owner who purchased the Canopy respirator new from Canopy or from an authorized Canopy distributor, and (ii) before the end of the warranty period.
- The Canopy respirator or component is found by Canopy to have been defective in normal use and service during the warranty period from the date of purchase by the original owner.
- This limited warranty does not apply (i) to any Canopy respirator or component found by Canopy to have become defective as a result of any accident, alteration, misuse, abuse, or servicing with parts not approved by Canopy; (ii) to deterioration or aging of any component made of silicone or other elastomer since such components can be adversely affected by undue exposure to heat, sun, water, chemicals, ozone or other deteriorating elements; or (iii) to overuse of the interchangeable filter past the recommended time frame, as outlined in the User Manual. The decision as to what constitutes normal use shall be made solely by the Canopy team.
- To maintain this limited warranty, the purchaser must (i) register their device online within seven days of receiving their Canopy respirator, and (ii) perform maintenance and inspections as set forth in the User Manual which shall include prompt replacement or repair of defective parts, and replacement of the interchangeable filter per the maintenance schedule as set forth in the User Manual.
The owner assumes all other risks, if any, such as the risk of any direct, indirect or consequential loss or damage arising out of the use of, or inability to use, the product. Servicing Canopy respirators with parts not approved by Canopy will void this limited warranty and the NIOSH certification for the respirator unit. This limited warranty is made in lieu of all other warranties, express or implied, and may not be varied or extended except in writing by an authorized official of Canopy.
Canopy does not guarantee a particular product’s immediate or continued availability. If we are unable to fulfill an order, you will be entitled to a full refund. You are responsible for inspecting your order upon receipt. Any damage occurring during shipment is the responsibility of the carrier, subject to tariff and other limitations on the carrier’s liability, if any. The carrier will not be required to obtain a signature at delivery unless you specify otherwise when placing your order.
All requests for returns must be made in writing not later than ten (10) days after the carrier delivers your order. If your purchase is defective, we will either (i) replace the defective product with the same product or its equivalent, or (ii) refund your purchase price, at our sole discretion. We may, but are not required, to accept returns for other reasons, in which case we will provide you with a replacement product or credit at our sole discretion. In order to request a return, you must submit your request at firstname.lastname@example.org. If we authorize your return request, you will be provided with a return authorization code. We will not process any return without a return authorization code. Products must be returned in their original packaging.
Prices shown on the Canopy Site are in US Dollars, exclusive of shipping, taxes (including Sales and V.A.T., if any), insurance, duties and other charges imposed by third parties. All such charges will be reflected in a final summary of an order before the order is accepted.
In addition to product purchases, some other aspects of the Canopy Site may require you to pay a fee, the details of which are available in various areas of the Canopy Site that feature the ability to purchase products, features or services. You agree to pay all fees and applicable taxes incurred by you or anyone using your account. We may revise the pricing for products, services or features offered through the Canopy Site at any time. Unless otherwise noted, all currency references are in U.S. dollars. All fees and charges are payable in accordance with payment terms in effect at the time the fee or the charge becomes payable. If there is a dispute regarding payment of fees to, or products or services provided by, us, your account may be closed without warning or notice at our sole discretion.
EXCEPT AS OTHERWISE SET FORTH IN ANY RETURN POLICY OR CANCELLATION POLICY EXPRESSLY APPLICABLE TO OUR PRODUCTS, SERVICES OR FEATURES, YOU ACKNOWLEDGE AND AGREE THAT ANY APPLICABLE FEES AND OTHER CHARGES FOR PRODUCTS, SERVICES OR FEATURES ARE NOT REFUNDABLE IN WHOLE OR IN PART. YOU ARE FULLY LIABLE FOR ALL CHARGES TO YOUR ACCOUNT, INCLUDING ANY UNAUTHORIZED CHARGES.
